ZakShots Media Services Agreement (Terms of Service)

 

This Media Services Agreement (“Agreement”) is made between ZakShots (“Service Provider”) and the Client (“Client”). By booking ZakShots for photography and/or videography services, the Client agrees to the following terms and conditions:

 

1. Scope of Services

ZakShots agrees to provide photography and/or videography services as outlined in the Client’s specific booking or invoice. This includes the time spent shooting, standard post-production editing, and the delivery of the final digital files.

 

2. Booking, Deposit, and Payment

• Deposit: A non-refundable deposit of [Insert Percentage, e.g., 30%] of the total estimated cost is required to secure the date and time of the shoot.
• Final Payment: The remaining balance must be paid in full [Insert Timeframe, e.g., 7 days prior to the event / on the day of the shoot].
• Late Fees: Overdue payments may be subject to a late fee of [Insert Amount/Percentage] per week until paid.

3. Cancellations and Rescheduling

• Client Cancellation: If the Client cancels the shoot, the deposit is forfeited. Cancellations made within [Insert Timeframe, e.g., 48 hours] of the scheduled shoot may require full payment of the agreed-upon package.
• Rescheduling: The Client may reschedule the shoot once without penalty, provided notice is given at least [Insert Timeframe, e.g., 7 days] in advance. Subsequent rescheduling may require a new deposit.
• ZakShots Cancellation: In the unlikely event that ZakShots is unable to perform the services due to illness, emergency, or acts of God, all payments received (including the deposit) will be fully refunded, and ZakShots shall have no further liability.

4. Copyright and Usage Rights

• Ownership: ZakShots retains the full copyright to all images and video footage created during the provision of services.
• Client Usage: The Client is granted a non-exclusive, non-transferable licence to use, print, and share the delivered media for personal, non-commercial purposes. [Optional: If providing commercial work, outline commercial licensing terms here].
• Portfolio Use: ZakShots reserves the right to use the media for promotional purposes, including portfolio display, website, social media, and advertising, unless a strict Non-Disclosure Agreement (NDA) is signed prior to the shoot.

5. Delivery and Archiving

• Turnaround Time: Final edited media will be delivered within [Insert Timeframe, e.g., 2-4 weeks] after the shoot.
• Raw Files: Unedited, RAW image and video files will not be delivered to the Client unless specifically agreed upon in writing and subject to an additional fee.
• Archiving: ZakShots will store the final delivered media for a period of [Insert Timeframe, e.g., 6 months] after delivery. The Client is entirely responsible for backing up their files upon receipt.

6. Artistic Style and Editing

The Client acknowledges that they are familiar with ZakShots’ portfolio and are requesting services with knowledge of the Service Provider’s artistic style. Extensive retouching or re-editing beyond standard colour correction and grading will be billed at an hourly rate of [Insert Hourly Rate].

7. Client Responsibilities

The Client is responsible for securing any necessary permits, location fees, or permissions required to shoot at specific venues. The Client also agrees to assist and cooperate in achieving the desired results, including gathering necessary subjects for photos or videos.

8. Limitation of Liability

While ZakShots takes the utmost care with equipment and file management, in the event of partial or complete loss of media due to equipment failure, theft, or unforeseen circumstances, ZakShots’ liability shall be limited to a full or partial refund of the fees paid by the Client.
